Fairfield (NJ) The Fairfield Police Department announces the arrest of Timothy Deery (37) of Dobbs Ferry, New York for operating a motor vehicle while under the influence on February 9, 2020. On that date, at approximately 4:16 AM, Officer Michael Tilton was on patrol on Horseneck Road when he observed a 2000 gray Honda allegedly failing to maintain its lane. The vehicle was then stopped and found to be operated by Deery.
While engaging the driver, it is alleged that Deery displayed signs and symptoms consistent with being under the influence to include a strong odor of an alcoholic beverage coming from his breath, his speech was slurred and his pupils did not react to light.
At this point, field sobriety testing was conducted and based upon the results and all of the other factors; Deery was placed under arrest and transported to headquarters for breath testing. His vehicle was impounded pursuant to New Jersey law. While at headquarters, it is alleged that Deery failed to comply with providing a mandatory breath sample.
In addition to the DUI charge he also received summonses for refusal to submit to breath testing, failure to maintain lane and careless driving. Deery was eventually released on his own recognizance pending an appearance in the Fairfield Municipal Court.
(It should be noted that the charges against Deery are merely allegations and that he is presumed innocent until he either pleads guilty or is found guilty in a court of law)
