Whippany Resident Arrested for Driving While Intoxicated Following Motor Vehicle Stop

Fairfield (NJ) The Fairfield Police Department announces the arrest of Timothy Erven (33) of Whippany, NJ for driving while intoxicated on April 17, 2023. On that date at approximately 12:26 am, Corporal Jeffrey Dean was monitoring traffic on Route 46 East. He allegedly observed a black BMW pass his location while following another vehicle at a close distance. As Corporal Dean followed the BMW, he also observed several motor vehicle violations, to include the vehicle being unable to maintain its lane.


Corporal Dean conducted a motor vehicle stop and spoke with Erven who was the driver and only occupant. He detected a strong odor of an alcoholic beverage emanating from Erven’s breath. It is alleged that Erven’s displayed signs and symptoms consistent with an individual who is under the influence of an alcoholic beverage to include glassy eyes and slurred speech. Erven allegedly also was unable to provide the requested documents to Corporal Dean. After further testing, Erven was placed under arrest for driving while intoxicated. His vehicle was impounded pursuant to NJ Law.


Erven was transported to police headquarters for processing where breath samples were provided for testing purposes and the results were found to be above the legal limit. In addition to being charged with driving while intoxicated, Erven was charged with possession of drug paraphernalia and possession of 5 or more doses of a prescription legend drug without a valid prescription. Erven’s vehicle was also found to be unregistered

and he was charged with several additional motor vehicle violations. Erven was later released pending a June 14, 2023 appearance at the Essex County Superior Court.



(It should be noted that the charges are merely allegations and that there is a presumption of innocence until Erven either pleads guilty or is found guilty in a court of law)
